Terms of Service — Valko
1. Acceptance of Terms
By creating an account or using Valko (available at valko.ai), you agree to these Terms of Service. If you do not agree, do not use the service. Your continued use after any changes constitutes acceptance.
2. What Valko Is
Valko is an AI-powered service provided by Inctasoft OOD. It lets you interact with multiple AI models including Claude (Anthropic) and Gemini (Google). Valko does not replace professional advice of any kind.
3. Eligibility
You must be at least 16 years old to use Valko. Valko is not directed at children under 13.
4. Account
Valko uses Google Sign-In for authentication. You are responsible for all activity through your account and must notify us immediately of unauthorized access at office@inctasoft.com.
5. Free and Paid Plans
Free plan: Subject to daily usage limits which may change with notice.
Paid plans: Billed via Stripe on a recurring basis until cancelled. Cancel any time from account settings; effective at end of billing period. No partial refunds except where required by law.
6. Acceptable Use
You agree not to use Valko to violate applicable law, generate harmful content, scrape the service, impersonate others, circumvent usage limits, or damage our systems. We may suspend access for violations without notice.
7. AI-Generated Content
AI responses may be inaccurate or incomplete. They are not professional, medical, legal, financial, or psychological advice. Always verify important information from authoritative sources.
8. Your Content
You retain ownership of content you submit. You grant Inctasoft a limited license to process it solely to provide the service. We do not use your content to train AI models or sell it to third parties.
9. Privacy
Our Privacy Policy explains how we collect, use, and protect your data and is incorporated into these Terms.
10. Third-Party Services
We integrate with Anthropic (Claude), Google (Gemini, Sign-In, TTS), Stripe (payments), and Cloudflare (infrastructure). Your use is also subject to their respective terms and policies.
11. Intellectual Property
The Valko name, interface, and software are the intellectual property of Inctasoft. You may not copy, modify, or distribute any part without written permission.
12. Disclaimer of Warranties
Valko is provided "AS IS" without warranties of any kind. We do not warrant uninterrupted, error-free, or secure operation.
13. Limitation of Liability
To the fullest extent permitted by law, Inctasoft shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the greater of the amount you paid us in the three months preceding a claim or €50.
14. Indemnification
You agree to indemnify Inctasoft from claims arising from your use of Valko or violation of these Terms.
15. Termination
We may terminate or suspend access at any time. If terminated without cause, prepaid unused fees will be refunded pro-rata. You may delete your account from settings at any time.
16. Changes to These Terms
We may update these Terms. Material changes will be communicated by email or in-app notice. Continued use constitutes acceptance.
17. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Bulgaria. Disputes shall first be attempted informally; if unresolved, submitted to the competent courts of Sofia, Bulgaria. EU consumers may also use the EU Online Dispute Resolution platform.
